Does General Assembly Resolution 377 (V) “Uniting for Peace” have the necessary legal foundations to sanction military intervention?

It has now been five years since the start of the civil war in Syria. A reported 470,000 people have been killed and yet, the Security Council still remains deadlocked over the situation. This leads to the assumption that the Council are failing in their primary role as maintainer of international peace and security. Furthermore, it has been posited by the International Court of Justice that the Council is not the only organ of the United Nations with such a role. Does this therefore mean that the Assembly may assume this role? It is imperative that the Syrian people get the help they need but difficulty remains as to how this can be achieved. Thus, it is to the General Assembly one must look towards and specifically, the Uniting for Peace Resolution. This paper will assess whether the Assembly is able to take over the functions of the Council within the sphere of international peace and security, and thus, authorise enforcement action.
